An Arizona evangelist is challenging Tucson’s restrictions on religious speech after police allegedly threatened him with arrest for sharing his Christian faith at a public street festival.
David Hoffman’s lawsuit concerns the December 2025 Winterhaven Festival of Lights. According to his attorneys at First Liberty Institute, Hoffman and friends offered religious literature and spoke with attendees willing to listen.
The attorneys allege that officers enforced a festival policy prohibiting religious messaging and directed the group to a barricaded area outside the event’s main footprint. They argue that the restrictions violated constitutional protections for peaceful religious expression on public streets.
First Liberty announced the lawsuit and a request for a preliminary injunction on October 8, 2026. Additional news coverage appeared October 18. The weekend reporting concerns an existing legal challenge rather than a new court ruling.
Hoffman is seeking protection against future enforcement of the restrictions. Tucson told reporters that it does not comment on pending litigation.
The allegations have not been established by a final court judgment. The case concerns how cities regulate expression during public events while protecting constitutional rights.
